The employer requested that the amounts no longer be refundable for breach of the confidentiality clause of the agreement. The EAT overturned the Labour Court`s decision and found that Mr Williams had been wrongly constructively dismissed. The EAT found that the employer`s conduct against Mr Williams constituted a fundamental offence and, therefore, when he resigned, at least in part, his constructive action for dismissal was brought in response to that conduct. This was the case, although subsequent behavior „knocked over“ the worker to resign. Confidentiality clauses in transaction agreements may have a number of restrictions. Many privacy rules prohibit parties from disclosing the terms of the transaction. .
